Introduction and Agreement
This website (“Site”) is owned by Big Brand Novelties Trading cc (“the Company” / “us” / “we”). The Site incorporates the Scratch Solutions Online Site and, except where the context otherwise indicates, references to “the Site” include the Scratch solutions Online Site. The Site promotes the sale of the Company’s products as well as other products (collectively “the Products”).
By shopping or browsing on this Site, you:
Represent and warrant that you have read and understood these terms and conditions as well as the policies displayed on this Site; and agree to be bound by these terms and conditions as well as the policies (collectively “the Agreement”).

Product Pricing and Availability
The Products displayed on this Site are subject to availability. The Company reserves the right, without prior notice, to discontinue or change pricing or specifications on Products and services offered on this Site without incurring any liability whatsoever.
Delivery
Delivery methods for deliveries from Scratch Solutions Online Store will include 1) Collection from our business address (Edenvale) or 2) By Courier (The Courier Guy) or 3) By our Company Driver to the Customer’s chosen delivery address.
Our deliveries will take place from 8AM until 5PM from Monday to Friday
Delivery is dependent on destinations within South Africa, and therefore delivery can take anything from 3 to 5 working days.
If your recipient lives somewhere far away that falls into our extended areas list, the delivery may take between one and two extra days to be delivered.
If we must reattempt your delivery more than twice, we may charge you a handling fee of 15% plus delivery.
We will, try our best to deliver at reception, receiving, security or a neighbour if they aren’t available.
In the event that the products are delivered in a damaged or defective state, the Customer shall forthwith upon delivery endorse Scratch Solutions’ copy of the delivery note detailing the damage or defects to the Products and the Customer shall within seven (7) days of such delivery notify Scratch Solutions of such damage or defects to the Products delivered, following which the Returns Policy shall be followed.
Personalised Gifts (Including Apparel)
It is the customer’s responsibility to select the correct size and colour of the gift.
Not every size fits all! Therefore, it is the customer’s responsibility to ensure the correct clothing and apparel size is chosen based on the provided sizing chart, make sure they’re the correct size!

it is the customer’s responsibility to ensure the correct personalisation information is provided. This includes any names, surnames, messages and photos.
Cancellation of personalised orders that have already been sent for production: If the personalisation process has already been completed, you will only be offered a 50% refund.
Colours
Scratch Solutions has made every effort to display as accurately as possible the colours of the Products that appear on the Site. As the actual colours you see will depend on your computer’s monitor, we cannot guarantee, however, that your monitor’s display of any colour will be accurate.
Artwork
The Company endeavours to match your artwork as closely as possible. However, if specific printing is required, the Client is to note the following:
Branding: All artwork needs to be print ready. Should the artwork not be print ready, the Company will charge an editing fee of R50 and/or a design fee of R250 per hour.
The artwork must be supplied in the following formats:
Photographic Images: High resolution JPEG Format
Interlaced PNG for transparent backgrounds
Vector Images converted to curves
Word files only as layout samples: please send artworks separately as accepted file format.
Embroidery: All artwork needs to be print ready. There is a standard setup fee of R250 per artwork for digitisation of the artwork. Thereafter the cost per print is charged separately.
Ownership and Copyright
All intellectual property rights, including copyright, in all materials, including trademarks, logos, photographs, images, text and other graphics which form part of the Site are owned by the Company alternatively the Company is the lawful user thereof. Such rights are protected by both South African and international intellectual property laws. All data and information communicated to or from the Site and/or any Site information as well as the database is the sole property of the Company.
The Company grants you permission to view, electronically copy and print portions of the Site for the sole purpose of placing an order with the Company for any of the Products.
Any use of materials on the Site other than for the purpose noted above including, without limitation, the unauthorised submission, removal, modification, dissemination, copying or distribution of copyrighted or other proprietary content, without the prior written consent of the Company and/or the lawful trademark and/or copyright owner (if applicable), is prohibited and constitutes an unlawful infringement of the intellectual property rights of the Company and/or such trademark and/or copyright owner.
Trademarks
“Scratch Solutions – Big Brand Novelties Trading”, the Scratch Solutions - bbn logo and all other marks, logos and trade names appearing on this Site are trademarks of either the Company, its holding company or affiliates in the Republic of South Africa, or of third parties who have authorised the Company to display such trademarks on the Site. Nothing contained on this Site should be construed as granting, by implication or otherwise, any license or right to use any of the trademarks displayed on this Site without the express prior written consent of the Company. Your use of any of the trademarks displayed on the Site or in any of its contents is strictly prohibited. You may not copy, reproduce, publish, upload, post, transmit, distribute or modify any of the trademarks appearing on this Site. You further undertake not to infringe any right of the Company or trademark owners in respect of such trademarks. The use of the trademarks on any other website or networked computer environment is prohibited.
Unlawful use
You shall not use this Site to send or post any message or material that is unlawful, harassing, defamatory, abusive, threatening, obscene, sexually orientated, racially offensive, profane or which violates any applicable law and you hereby indemnify the Company against any loss, liability, damage or expense of whatever nature which the Company or any third party may suffer and which is caused by or attributable to, whether directly or indirectly, your use of the Site.
Links and Advertising
No person, business or other website may link to any page on this Site without the prior written permission of the Company.
External hyperlinks may be provided on the Site, but such links are beyond the Company’s control. You shall not interpret the provision of such hyperlinks as constituting any relationship between the Company and any linked third party, nor as an endorsement by the Company of such third party. Hyperlinks provided on this Site to other websites are provided as is and the Company does not necessarily agree with, edit or sponsor the content of such websites. Coupons and Vouchers
It is important to check the expiry dates on coupons, as you don’t want to miss out on a good deal!
Each coupon is valid for only one purchase session and only one coupon may be redeemed per person, per transaction.
Vouchers and/or coupons aren’t redeemable with any promotions (On Sale Items).
No “change” is given on any coupons and they aren’t transferable for cash.
We reserve the right to cancel orders placed if there has been misuse of the voucher or unsolicited voucher use.
Export restriction
The offering on this website is available to South African clients only.
Customer Privacy policy
Big Brand Novelties Trading cc shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, “personal information” shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). Card acquiring and security
Card transactions will be acquired for Big Brand Novelties Trading cc via Payfast 3D Secure who are the approved payment gateway for all South African Acquiring Banks. Payfast 3D Secure uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the website. Users may go to www.payfast.co.za to view their security certificate and security policy.
Customer details separate from card details
Customer details will be stored by Big Brand Novelties Trading cc separately from card details which are entered by the client on Payfast’s secure site. For more detail on Payfast refer to www.payfast.co.za.
Merchant Outlet country and transaction currency
The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).
Responsibility
Big Brand Novelties Trading cc takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods.
Country of domicile
This website is governed by the laws of South Africa and Big Brand Novelties Trading cc chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature, 6 6 Sixth Avenue, Edenvale 1609.
Variation
Big Brand Novelties Trading cc may, in its sole discretion, change this agreement or any part thereof at any time without notice.
